J. Giesbrecht & Son Cranes LTD. is a Crane Rental Company with a firm and
longstanding commitment to the protection of our customers' privacy, and confidential
information. Our commitment to protecting your private information extends to
our other organization Indecom Rigging and Moving LTD.
Consistent with the privacy requirements of the Personal Information and Electronic
Documents Act (PIPEDA), we adhere to the duty to hold in strict confidence all
information concerning the business, affairs, and personal information of our
clients gathered in the course of our professional relationship, and not to
divulge such information unless expressly or impliedly authorized by our clients,
required by law, or otherwise permitted or required by any organization that
has the power to request such information.
We are responsible for the personal information that we collect. Our office
stores and maintains your personal information in conformity with the requirements
and principles of the Personal Information Protection and Electronic Documents
Act. To ensure our accountability, and to protect our clients' private information,
we have developed this privacy policy, and trained our staff to permit them
to implement and observe this and other policies, and practices legislated both
Federally, and Provincially.
WHAT IS PERSONAL INFORMATION?
Personal information is any factual or subjective information, recorded or not,
about an identifiable individual, or company.
WHY DO WE COLLECT PERSONAL INFORMATION?
We provide heavy lift, and rigging services to a wide range of clients. In doing
so, we collect personal information by fair and lawful means for the following
limited purposes:
(a) To complete daily transactions with our clients.
(b) To maintain communications with our clients.
(c) To provide our clients with information and services that we may at one
point in time complete for them.
HOW DO WE COLLECT PERSONAL INFORMATION?
Wherever possible we collect our clients' personal information directly from
them, at the start of a project, and in the course of our relationship.
Sometimes we may obtain information about our clients from other sources: for
example,
" The internet (if possible)
" When establishing credit within in our company.
CONSENT
In most cases, we shall ask our clients to specifically consent, if we collect,
use or divulge their personal information. Normally, we ask for our clients
consent in writing, but in some circumstances, we may accept their oral consent.
At times, our clients consent may be implied through their conduct with us.
USE OF YOUR INFORMATION
We use our clients' personal information to administer our client (Project,
and billing databases), and to provide our clients with information and services
regarding the crane rental, and rigging services that we provide. If our clients
tell us that they no longer wish to receive information about our services,
or new developments within our industry, we will not send any further material.
We do not disclose, to our knowledge, our clients' personal information to any third party to enable them to market their products and services.
DISCLOSURE OF OUR CLIENTS' PERSONAL INFORMATION
Under certain circumstances, we may be obliged, justified or permitted to disclose
our clients' personal information without their knowledge or consent. These
circumstances may include:
" When we are required or authorized by law to do so.
" Where it is necessary to establish or collect fees.
" If we engage a third party to provide administrative services to us,
and the third party is bound by our privacy policy.
" If the information is already publicly know.
UPDATING YOUR INFORMATION
Since we use our clients' personal information to provide services, it is important
that the information be accurate and up-to-date.
If during the course of our relationship with our clients, their information changes, they can inform us so that we can make any necessary changes.
INFORMATION RETENTION AND DESTRUCTION
Upon conclusion of work for which personal information was collected, and payment
of the account, the project file will be closed.
Consistent with time limitation requirements under the law, and Revenue Canada, our clients' accounts, and other related information would be retained in a secure setting until destroyed.
Generally files involving commercial finance transactions will be destroyed after seven years.
HOW IS OUR CLIENTS' PERSONAL INFORMATION SECURED?
J. Giesbrecht & Son Cranes LTD. takes all reasonable precautions to ensure
that our clients' personal information is kept safe from loss, unauthorized
access, modification, or disclosure. Among these steps taken to protect our
clients' information are:
" Premises security, including locks, and restricted access.
" Restricted file access to personal information.
" Deploying technological safeguards like security software encryption,
and firewalls to prevent hacking or unauthorized computer access.
" Internal password and security policies.
ACCESS TO OUR CLIENTS' PERSONAL INFORMATION
Our clients' may ask our office staff for access to any personal information
that we may hold about them. If a client is not satisfied they may contact J.
Giesbrecht & Son Cranes LTD, privacy officer.
Summary information is available on request. More detailed requests, which require archive, or other retrieval cost may be subject to fees.
CORRECTING ERRORS
If we hold information about our clients and they can establish that it is not
accurate, complete and up-to-date, we will take reasonable steps to correct
it. If the information cannot be changed our clients request and our decision
will be noted.
EXCEPTIONS TO ACCESS
We will endeavor to provide our clients with access to their personal information.
However, in certain circumstances it may not be possible. In any case where
we are unable to or cannot grant our clients access to their personal information
we will provide them with reasons on request.
EXCEPTIONS TO ACCESS MAY INCLUDE
" Information that has been destroyed.
" Information that is related to a third party or would reveal confidential
commercial information, and which cannot be severed from disclosure.
" For any other legal and security reasons which relate to the enforcement
of any law of Saskatchewan, or Canada.
COMMUNICATING WITH US
Our clients' should be aware that e-mail and cell phone communications are not
100% secure mediums, and they should be aware of this when contacting us to
send personal or confidential information.
CHANGES TO THIS PRIVACY POLICY
Since we regularly review all of our practices, policies, and procedures, we
may change our Privacy Policy from time to time.
